Tax-Free Donations For Estonian Companies
In Estonia, companies can deduct gifts and donations from their taxable income when they contribute to tax-exempt non-profit associations, foundations, and religious groups approved by the Estonian Tax and Customs Board.
According to subsection 66 of § 61 of the Income Tax Act, a resident legal person shall not pay income tax on the donations and gifts made to preserve the territorial integrity and sovereignty of Ukraine and to provide and organise targeted humanitarian aid if the donations and gifts are made from 1 January 2024 to 31 December 2025 to the following organisations: Estonian Rescue Association, Estonian Refugee Council, NGO Mondo, Estonian Red Cross, Ukrainian Cultural Centre, National Defence Promotion Foundation, and Rotary Club Tallinn Vanalinn.
Estonian companies can provide services (e.g., accommodation for Ukrainian war refugees, transport, etc.) and donate goods (e.g., humanitarian aid) to the above-listed organisation, exempt from income tax. The donations do not need to be reported on TSD (income and social tax declaration).
Annual Tax-Free Limits for Donations to Other NGOs
Estonian companies may also donate to other Estonian tax-exempt non-profits. Still, you should note the annual tax-free limits when donating to other NGOs: up to 3% of total wages paid during the fiscal year or 10% of the previous financial year’s profit, whichever is more advantageous. Donations beyond these limits are subject to the standard corporate income tax rate. Donations must be declared in Annex 5 of the TSD tax declaration to ensure compliance.
Ways to Help Ukraine Through Your Estonian Company
When you’re ready to support Ukraine through your Estonian company, here are some organisations and initiatives offering secure options for donations and aid. When transferring from your company account abroad, such as Wise or Revolut, do not forget to add your company number to use the tax-free donation option. Tax-exempt NGOs in Estonia must report all donations received annually, including your company number, and the tax office can match the report with the amounts you have donated you declared on TSD forms. Estonian banks automatically disclose payee company numbers on incoming payments, so it is unnecessary when making domestic payments to those NGOs.
Estonian Rescue Association (Päästeliit)
The Estonian Rescue Association is gathering donations to assist rescue workers in Ukraine. They accept specific rescue equipment and monetary donations to help support and equip Ukrainian emergency response teams.
Estonian Rescue Association needs specific items that will directly aid Ukrainian rescue efforts. The following equipment is especially welcomed but can be bought with your financial contribution: firefighter boots, heat-resistant clothing, firefighter helmet liners, lightweight chemical protective suits, respirators with ABEK (gas and dust) filters, chemical compound identification kits (CAIS), drones with thermal cameras, helmet lights, portable gas detectors, thermal cameras, chainsaws.
